“THE MOST SERIOUS NON-COMPLIANCE IS NOT HAVING A COMPLIANCE PROGRAMME”

On 23 June, a seminar entitled “Compliance Programme and Criminal Prevention Programmes for SMEs – Advisable or necessary”, took place at the of the CEIM Business Confederation of Madrid-CEOE headquarters.
Organised by law firm EJASO, ETL Global and FENAC, the seminar was delivered by José Manuel Calavia, Professor of Commercial Law at the University of Barcelona, Adán Nieto, Professor in Criminal Law from the University of Castilla la Mancha and Carlos Castresana, head of the Criminal Law department at EJASO.
The presentation ceremony, courtesy of Guillermo Dionis – a partner at EJASO – was followed by a talk by José Manuel Calavia. Based on his experience as a company director in a number of sectors, he said that due to the complex nature of criminal compliance, he recommends implementing compliance programmes developed by independent experts.

During his talk, Adán Nieto stressed that a good Compliance Programme adds value and makes more business opportunities available to SMEs; because it are a clear sign of good management. Numerous public and private organisations prefer to do business with companies that have these protocols. He also said that the basis of a good compliance programme is risk analysis and a firm conviction by the directors that this is absolutely necessary for each company.
Carlos Castresana, the third and last of the speakers, commented on the growing number of financial offences committed in the corporate area (not to be confused with “the company”) adding that, in many cases, these offences are due to ignorance and the lack of an efficient Compliance Programme.
After discussing two recent judgements that show the importance of prevention and a round of questions, Castresana ended the meeting with an interesting reflection: “A snapshot isn’t enough. You need the film”. In other words, having the compliance programme and stuffing it in a drawer is not enough. It must be kept alive and fully operational.
Judging from the number of attendees and the positive opinions expressed at the end of the act, the seminar was a success and we are sure to organise more meetings in the future.
